Kerry Kennedy’s Motion For Dismissal Denied, Trial Likely

ARMONK, N.Y. – Bedford resident Kerry Kennedy was back in North Castle Town Court Tuesday night for the ruling on her motion for dismissal of her impaired driving charge from her car accident on Interstate 684 in Armonk in July. The news for Kennedy was not good, however, as her motion to dismiss the charge was “denied in all respects,” by Justice Elyse Lazansky.

Lanzansky announced the following pre-trial dates for Kennedy’s case moving forward:

  • July 12: Defendant’s motion
  • July 23: People’s response
  • Sept. 6: Defendant’s response
  • Oct. 8: Final decision

 

Following those dates, it is likely the case will go to trial in the fall, according to Kennedy’s attorney Gerald Lefcourt.

“We are very disappointed,” said Lefcourt Tuesday night.

“But we have every intention Ms. Kennedy will be exonerated, as there is absolutely no evidence that exists that suggests her accident was anything other than accidental ingestion. We expect a very clear trial,” he added. 

Lefcourt said Kennedy was not pleased with Tuesday’s ruling but is ready to handle the decision accordingly.

“She was not happy,” he said. “But it is what it is.”
