MOUNT KISCO, N.Y. -- A Mount Kisco man has been charged in the rape of a girl under the age of 11, but the investigation remained open and was continuing as of Friday morning, according to Mount Kisco police.
Rigoberto Julian Gutierrez, 41, was arrested Tuesday night and charged with first-degree rape, a Class B felony. He was accused of having intercourse with the young girl twice earlier this month, police said.
Gutierrez was arraigned by Mount Kisco Village Justice John Donohue on Wednesday and sent to Westchester County's jail in Valhalla without bail. Although he had a scheduled appearance in Mount Kisco Town Court on Thursday night, Mount Kisco police said there was no new information as of Friday morning.
The Westchester County District Attorney's Special Prosecution Unit helped with the investigation, police said.
Police were withholding the child’s name, age and address, along with the locations of the alleged incidents, as the investigation continued.
